The general concepts of commercial law are defined under the headings of merchant, commercial enterprise, trade registry, trade name, unfair competition, commercial books, current account, commercial affairs brokerage, agency, commercial partnerships.

Trade partnerships are collective, commandite, joint stock, limited and cooperative partnerships. The law regarding documents is grouped under the heading of negotiable instruments. The forms of issue are registered and bearer. Negotiable instruments are in the types of policies, promissory notes, cheques, privilege notes, and transportation bills.

Maritime law, insurance law (except social insurance) are other commercial law subjects.

A company is when two or more people come together and combine their labor or goods with a contract to achieve a common goal. As can be understood from this definition, the company; It consists of the elements of person, contract, capital, common purpose and joint effort. – Two or more people are required to establish a company. – In order to establish companies other than ordinary companies, company contracts must be in writing, signatures must be notarized and registered and announced in the trade registry. – Capital is the element needed because the company is an economic unity. Although money is the first thing that comes to mind as capital, labor can also be used as capital in other types of companies except joint stock and limited companies.

The minimum capital amount of the joint stock company is 50,000.00 TL. While the minimum capital amount of limited companies is 5,000.00 TL. Since the maximum amount of capital in these companies is determined by law, these companies are called companies with basic capital.

For the company to exist, these five elements must be fulfilled. Otherwise, the company agreement cannot be mentioned.
